What's the Difference? Motion to Reopen and Motion to Reinstate
HIGHLIGHTS
Reopening Cases. F.R.B.P. 5010
- Used when a case has been administratively closed by the court
- Fees involved in filing of motion

Reinstating Cases. F.R.B.P. 9014
- Used when a case has been dismissed but not administratively closed by the court
- No fees involved in filing of motion
- Filing requirements and step by step instructions
Determining status of a case
- Reinstated cases have a REINSTATED flag displayed in the top right corner of the docket
- Closed cases have DATE TERMINATED displayed in the top right corner of the docket
- Voice Case Information System (V.C.I.S.) can be used to determine open or closed status
- Case Closed on {date of closing} indicated at top of docketing screen in ECF
Trustee Reminder - Final Accounts:
When noting the objection time, it is important to allow three extra days for mailing for non-ECF users. This will insure the appropriate amount of objection time is allowed to everyone.
