HIGHLIGHTS
The Judicial Conference has approved several changes to the Bankruptcy Court Miscellaneous Fee Schedule which will become effective January 1, 2007.
New Fees for Converting will be the difference between the two filing fees:
- Chapter 7
- to Chapter 11 - $755 “excluded pursuant to 28 U.S.C. § 1930(a)"
- Chapter 13
- to Chapter 7 - $25
- to Chapter 11 - $765 “excluded pursuant to 28 U.S.C. § 1930(a)"
- Chapter 12
- to Chapter 7 - $60
- to Chapter 11 - $800
- to Chapter 13 - $35
Fees for Reopening:
- Chapter 7 - $260
- Chapter 13 - $235
- To permit a party to file a complaint to obtain a determination under Rule 4007(b), and
- When a creditor is violating the terms of the discharge under 11 U.S.C. §524
Reopening fee exemption for actions related to discharge:
There are two situations in which the exemption applies:
Fees for Splitting a case:
- Chapter 7 - $260
- Chapter 13 - $235
Direct Appeal Fee
- additional $200 when authorized by the court of appeals
